· Commercial snow removal.

· Parking lot snow plowing.

· Sidewalk and walkway snow clearing.

· Driveway snow clearing.

· Snow and ice management services, where offered.

· Other related snow removal services agreed upon with a customer.

Service availability depends on location, weather conditions, equipment availability, site accessibility, and the scope of work agreed upon.

Not every service is available at every property or during every weather event.

3. Estimates and Service Agreements

Customers may contact us to request an estimate or discuss their snow removal needs.

Any estimate, quote, or proposed service arrangement should identify the applicable services, pricing, scheduling expectations, and other material conditions where appropriate.

An estimate is not a guarantee that services have been booked or that a particular arrival time can be met.

A service arrangement becomes binding when accepted by both parties through an agreed method, subject to any applicable legal requirements.

If a written service agreement contains terms that conflict with these general Terms of Service, the specific written agreement will control for the conflicting service-related terms, to the extent permitted by law.

Customers are responsible for reviewing the scope of work and confirming that the requested services meet their needs before authorizing work.

4. Scheduling and Weather Conditions

Snow removal is affected by changing weather, snowfall intensity, road conditions, visibility, and other circumstances beyond our control.

Although we make reasonable efforts to schedule and perform services as agreed, we cannot guarantee an exact arrival time or completion time during severe or rapidly changing weather.

Service schedules may be adjusted because of:

· Heavy or prolonged snowfall.

· Freezing rain, ice storms, or rapidly changing temperatures.

· Unsafe road or property conditions.

· Equipment breakdowns or maintenance.

· Staffing limitations or unusually high service demand.

· Road closures, emergencies, or government restrictions.

· Other circumstances beyond our reasonable control.

Where possible, we will communicate significant scheduling changes to affected customers.

Customers with recurring service arrangements should review their individual agreements for details regarding service triggers, priority, service frequency, and seasonal coverage.

5. Customer Responsibilities

Customers must provide accurate information about their property, requested services, and contact details.

Before scheduled service, customers should, where reasonably possible:

· Ensure that the service area is accessible.

· Move vehicles, trash containers, and other removable obstacles away from the work area.

· Identify hidden hazards, delicate landscaping, unusual surface conditions, and known underground features.

· Clearly identify property boundaries and areas that should not be serviced.

· Secure pets and keep people away from active snow removal equipment.

· Notify us of special access requirements or property restrictions.

· Ensure they have authority to request work on the property.

Customers must not instruct our personnel to perform work that would create an unreasonable safety risk or violate applicable law.

If access is blocked or a property is unsafe, we may postpone, modify, or decline the affected work. Any resulting charges will be determined by the applicable service agreement and law.

6. Property Access and Authorization

By requesting services, you represent that you own the property or have the authority to authorize snow removal at the location.

You authorize our personnel to access the portions of the property reasonably necessary to perform the agreed services.

You must inform us of relevant property restrictions, access limitations, or conditions that could affect safe performance.

We will not intentionally enter areas outside the agreed service scope unless reasonably necessary to address an immediate safety concern or otherwise permitted by law.

7. Pricing, Payments, and Additional Charges

Service prices and payment requirements will be communicated through the applicable estimate, invoice, or service agreement.

Depending on the arrangement, pricing may be based on a per-visit charge, seasonal agreement, recurring service plan, property size, snowfall conditions, or another agreed pricing method.

Customers are responsible for paying the charges they have authorized under the applicable agreement.

Additional work outside the original scope may require approval and may result in additional charges.

Any applicable taxes, late fees, cancellation fees, or other charges must be disclosed and applied in accordance with the service agreement and applicable law.

If you have a question about an invoice or charge, contact us promptly so we can review the matter.

8. Cancellations and Service Changes

Customers who need to cancel, reschedule, or modify a service should contact us as soon as reasonably possible.

The cancellation terms, notice requirements, and any applicable fees will depend on the service agreement and applicable law.

Recurring or seasonal service arrangements may have additional requirements concerning cancellation, renewal, minimum service periods, or changes to service frequency.

We reserve the right to decline future work or suspend an arrangement when permitted by law, including when a property presents an unresolved safety concern, access is repeatedly unavailable, or payment obligations remain unmet.

Nothing in this section removes any cancellation or refund rights that may be provided by applicable law.

9. Snow and Ice Removal Limitations

Snow removal can reduce snow accumulation and help improve access to driveways, sidewalks, parking lots, and other agreed areas. However, snow and ice conditions can change rapidly.

We do not guarantee that a treated or cleared surface will remain completely free of snow, ice, moisture, or slippery conditions.

For example:

· Snow may continue accumulating after service is completed.

· Ice may form again when temperatures drop.

· Meltwater may refreeze on previously cleared surfaces.

· Compacted snow and existing ice may be difficult to remove completely.

· Drifting snow may return to a cleared area.

· Surface irregularities may remain hidden beneath snow or ice.

Deicing products or treatments may reduce certain risks but cannot eliminate every hazardous condition.

Customers should exercise reasonable caution when walking or driving in winter conditions, even after snow removal has been performed.

Any special requirements concerning repeat visits, snowfall thresholds, deicing, or monitoring must be agreed upon separately where applicable.

10. Property Conditions and Potential Damage

Snow removal equipment may operate near pavement, curbs, landscaping, steps, fences, drainage features, and other property elements.

Customers should identify known hazards and mark vulnerable or concealed features before service whenever reasonably possible.

We will exercise reasonable care when performing authorized work. However, preexisting damage, concealed obstacles, unstable surfaces, improperly marked hazards, and other site conditions may affect the work and its outcome.

If you believe damage occurred during a service visit, please contact us promptly with the property address, service date, a description of the issue, and any supporting photographs.

We will review reported concerns in a reasonable manner.

Nothing in these terms excludes responsibility for damage or injury to the extent that such responsibility cannot lawfully be excluded or limited.

11. Limitation of Liability

To the extent permitted by applicable law, Louisville Snow Removal Elite will not be responsible for indirect, incidental, special, exemplary, or consequential damages arising from the use of our website or services.

We do not guarantee that our website will always be available, error-free, or compatible with every device or browser.

Nothing in these Terms of Service excludes or limits liability for gross negligence, willful misconduct, fraud, or other liability that cannot legally be excluded or limited.

Any limitation of liability applicable to a particular service will be interpreted in accordance with Colorado law and any applicable written service agreement.

12. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your material breach of these terms, your unlawful conduct, or your unauthorized instructions concerning the property.

This provision does not require you to indemnify us for our own negligence, willful misconduct, or other conduct where such an obligation would be prohibited by law.

13. Website Use and Intellectual Property

All original text, branding, graphics, and other materials appearing on our website are owned by Louisville Snow Removal Elite or used with appropriate authorization, unless otherwise indicated.

You may view and use the website for personal, informational, and legitimate business purposes related to our services.

You may not, without appropriate authorization:

· Copy or republish substantial website content for commercial use.

· Use our branding to misrepresent an affiliation with our business.

· Attempt to interfere with website functionality or security.

· Submit fraudulent inquiries or malicious material.

· Use the website in violation of applicable law.

We may update, remove, or modify website content at any time.

14. Third-Party Links and Services

Our website may include links to third-party websites, mapping tools, social media platforms, payment services, or other external resources.

These services are operated by third parties and may be subject to separate terms, privacy policies, and fees.

We do not control third-party websites and are not responsible for their content, availability, or practices, except to the extent applicable law provides otherwise.

15. Force Majeure

We will not be considered in breach of a service commitment to the extent performance is prevented or materially delayed by circumstances beyond our reasonable control, subject to applicable law and the terms of any specific service agreement.

Such circumstances may include severe weather, natural disasters, road closures, governmental restrictions, emergencies, equipment failures caused by extraordinary events, or interruptions to essential supplies.

Where reasonably possible, we will communicate material delays and work with affected customers to determine an appropriate next step.

This provision does not automatically cancel payment obligations for services already performed or override any rights or remedies required by law.

16. No Guarantee of Specific Results

Descriptions on our website are provided for general informational purposes.

Actual service outcomes may vary based on property conditions, snowfall, ice formation, access, surface materials, and the specific services purchased.

Unless expressly stated in a written agreement, we do not promise that a property will remain entirely free of snow or ice or that every winter-related hazard will be eliminated.

17. Privacy

Your use of our website is also subject to our Privacy Policy, which explains how we handle personal information.

By using our website or contacting us, you acknowledge that you have had the opportunity to review the Privacy Policy.

Any consent required by applicable privacy law must be obtained separately where necessary. Using our website alone does not constitute consent to every possible form of data processing.

18. Changes to These Terms

We may revise these Terms of Service from time to time to reflect changes in our services, website functionality, business practices, or applicable law.

Updated terms will be posted on this page with a revised “Last Updated” date.

Changes will apply as permitted by law. Changes to an existing service agreement may require the parties' agreement or other notice where legally required.

19. Governing Law and Disputes

These Terms of Service are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Any dispute concerning these terms or our services will be handled through the courts or other dispute-resolution procedures that have jurisdiction under applicable law.

Nothing in this section prevents either party from exercising rights that cannot lawfully be waived or restricted.

20. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Any invalid or unenforceable provision will be interpreted or limited only to the extent necessary to make it enforceable, where legally permissible.

21. Entire Agreement

These Terms of Service, together with any applicable written estimate, service agreement, and Privacy Policy, describe the general terms governing use of our website and our relationship with customers.

A separate written service agreement may establish additional terms for a particular property or service arrangement.

Nothing in these terms overrides a mandatory legal right or obligation.

22. Contact Information
